What Is a Title Transfer?
A title transfer is the legal process of changing vehicle ownership from one person to another. In California, this is required whenever a vehicle is sold, gifted, inherited, or added/removed from joint ownership. The California DMV requires the transfer to be completed within 10 days of the sale or transfer date to avoid late fees.
When Do You Need a Title Transfer?
- Buying or selling a vehicle (private party or dealer)
- Receiving a vehicle as a gift from a family member or friend
- Inheriting a vehicle after the passing of the owner
- Adding or removing a name from the title (for example, after marriage or divorce)
- Transferring between family members (parent to child, spouse to spouse)
Required Documents
To complete a title transfer at NITRA Agency, you will need:
- Signed Title (Pink Slip) – The seller must sign the back of the title and print their name. The buyer signs in the designated area as well.
- Valid California ID or Driver's License – Both the buyer and seller should have valid identification.
- Smog Certificate – Required for vehicles 4 model years and older. Must be obtained within 90 days of the transfer. Exemptions apply to diesel vehicles 1997 and older, electric vehicles, and hybrids.
- REG 262 Form (Vehicle/Vessel Transfer and Reassignment Form) – Required if the title doesn't have enough space for signatures or if the title is missing.
- Odometer Disclosure – Required for vehicles less than 10 model years old.
- Bill of Sale – While not always required by the DMV, we strongly recommend having one for your records. Include the sale price, date, VIN, and both parties' names.
Fees You Should Expect
| Fee Type | Amount |
|----------|--------|
| Transfer Fee | $15 |
| Use Tax | Based on purchase price (varies by county) |
| Smog Transfer Fee | $8 |
| Late Transfer Penalty | $30 (if filed after 10 days) |
Pro Tip: If the vehicle is a gift between immediate family members, you may be exempt from use tax. Ask our team about the Statement of Facts (REG 256) form to claim the exemption.
How Long Does It Take?
At NITRA Agency, most title transfers are completed in 20 to 30 minutes. Here's the general timeline:
- In-office processing: 20 to 30 minutes
- New title mailed by DMV: 4 to 6 weeks
- Temporary registration: Issued same day
Common Mistakes to Avoid
1. Not Signing the Title Correctly
The most common issue we see is incorrect signatures on the pink slip. Both buyer and seller must sign in the correct areas. If you make a mistake, do not use white-out. This will invalidate the title.
2. Missing the 10-Day Deadline
California law requires the new owner to transfer the title within 10 days. After that, you'll face a $30 late penalty. Don't wait!
3. Skipping the Smog Check
Many buyers assume the seller handled the smog check. Always verify you have a valid smog certificate before coming in for the transfer.
4. Not Getting a Bill of Sale
While technically optional for the DMV, a bill of sale protects both the buyer and seller in case of disputes about the sale price or terms.
5. Forgetting to Update Insurance
Your insurance must be updated before you drive the vehicle. We can help you get covered the same day at our office.
Family Transfers and Gift Exemptions
Transferring a vehicle between immediate family members (parent, child, spouse, sibling, grandparent, grandchild) may qualify for a use tax exemption. You'll need to:
- Complete a REG 256 (Statement of Facts) indicating the transfer is a gift
- Both parties must sign the form
- The title must show $0 or "gift" as the purchase price
